Our Attorneys appear before the local district, superior, land, probate and federal courts throughout the Commonwealth of Massachusetts. We have experience handling commercial litigation, INCLUDING corporate, shareholder and partnership disputes; construction claims; condominium litigation, real estate DISPUTES, including actions for specific performance, LOT LINE/BOUNDARY ISSUES, breach of contract, negligence, breach of fiduciary duty, accountings and quiet title actions; insurance coverage disputes; and actions relating to the recovery AND DIVISION of personal and real property. While litigation is often times unavoidable, the firm counsels its clients as to the intricate process of litigation, prior to the institution of and throughout the entire litigation process. The litigation process commences with an investigation and evaluation of a client's claims or defenses, and an analysis of the client's rights, duties and obligations in order to effectively evaluate the case consistent with the client's expectations and goals. The process proceeds with filing and/or responding to the complaint, and then conducting the discovery required to properly prepare or defend the case.
Through our attorneys' counseling, clients are afforded the opportunity to make more informed decisions on whether to litigate or settle disputes; and, if litigated, how to properly prepare the case for trial, and whether to settle during the course of the proceedings in a manner most favorable to the client. When appropriate, our firm participates in many means of alternate dispute resolution sources, e.g., alternatives such as the American Arbitration Association, and private arbitration and/or mediation processes.
Various members of the firm serve as court-appointed arbitrators or mediators.
Estate Planning and Probate Administration
Our firm provides legal counsel in all matters related to estate planning and probate admininistration. In our estate planning practice, we help clients plan for the orderly distribution of their estates. We review and draft all the necessary documents to construct an effective estate plan, including wills, trusts (revocable and irrevocable), powers of attorney, and heath care directives. In our probate adminsistration work, we represent estates in the probate court to ensure the orderly distribution of assets. This ofteninvolves preparing an inventory of assets, obtaining property valuations (when necessary), ensuring payment of estate obligations (including taxes), and overseeing the distribution of the estate in accordance with the decedent's wishes.

The firm handles the process of estate filings with the Probate and Family Courts. While acknowledging that this is often a difficult and emotional time for our clients, often there may be issues that require Court intervention and result in the filing or defense of a Probate action. This may include will contests, disputes over estate/asset division, estate administration including executor or administrator appointments, and the objections to certain fiduciary appointments.
Real Estate
Our firm represents commercial and residential clients in all matters related to real property (land and the structures attached to it), including purchase and sale agreements, construction contracts, mortgages and foreclosures, leases, zoning disputes, title examinations, quiet title actions, closings, and property management. Our attorneys handle residential and commercial conveyancing and act as approved title insurance agents underwriting for the Chicago Title Insurance Company.
Estate Planning
Our firm handles Estate Planning matters which is the area dealing with the distribution of an individual`s property at his or her death, taking into account wills, taxes, insurance, property, and trusts so as to gain maximum benefit of all laws and, at the same time, carrying out the person`s wishes. Probate is the court proceeding through which a will is proved to be valid and the estate of a decedent is administered. The process, generally, includes collecting a decedenti`s assets, liquidating liabilities, paying necessary taxes, and distribution of property to heirs.
